CHILD CUSTODY ISSUES

There are many child custody issues that the courts must take into consideration when determining how the child will spend their life growing up. It is a big decision and the courts want what is best for the child. The child is already going through something traumatic and the courts want to make the transition go as smoothly as possible for the child. Things the courts will take into consideration is the living situation, stability of the parents, financial means of the parents, siblings, and the child’s relationship with each of the parents.

When the courts look at the child custody issues they must look at the current living situation of both of the parents. Usually, one of the parents moves out of the house they were living in. If both parents move into a new home, then the decision will be more difficult because usually the courts don’t want to remove the child from their home. Moving a child to a new home can be traumatic in addition to the parents splitting up.

The parent’s stability is another one of the child custody issues that the judge must look at and take into consideration. This includes how often the parents move, how long they have held down the same job, etc. Stability is important for a child and the judge doesn’t want too much change in a child’s life.

Siblings make child custody issues easy for a judge to determine where the child will live. In most cases, the child will stay in the home where the siblings are living. In cases where there is severe conflict with the siblings is the only situation where you would see a judge go in the other direction.

When child custody issues are not easily determined by the courts or the judge is having a difficult decision, often times they will bring in a family court appointed person to come into the home of each parent and review the child’s relationship with the parent and the living conditions. This will allow the judge to make a more sound decision by their recommendations.

There are many child custody issues that a judge will take into consideration when making a decision on who to place the child with when there is a divorce.
